Subject: Cost Recovery Fee Schedule for the Public
Program Area: Cost Recovery
Purpose: This Instruction Memorandum (IM) updates the Bureau of Land Management (BLM) cost recovery fee rates and supersedes IM 2009-037.
Policy/Action: The new fee schedules are included with this IM as Attachment 1. These rates match the latest Department of the Interior (DOI) FOIA fee structure (43 CFR Part 2, Appendix C), published August 1, 2009. Any search requests received prior to that date must be processed at that year’s rates. Each Office must post the current fee schedule in their local Information Access Centers (IACs) and make copies available to the public.
If a member of the public requests copies of information or data for which no standard fee is listed in the schedule, then the State or Center Records Administrator should develop an estimate of the costs involved.
Timeframe: Effective immediately.
Budget Impact: None.
Background: The Office of Management and Budget (OMB) Circular A-130 provides guidance to Federal Agencies for determining costs for providing copies of information to the public.
The Federal Land Policy and Management Act (FLPMA), P. L. 94-579, Section 304. [43 U.S.C. 1734] authorizes the BLM to charge and collect for the cost of providing information to the public.
