Subject: Review Requested of Draft Instruction Memorandum Regarding Reporting Results of Tribal Consultation to the State Historic Preservation Office

The Bureau of Land Management, Nevada, must report results of tribal consultation to the Nevada State Historic Preservation Office as a component of BLM’s obligations under the National Historic Preservation Act, as filtered through both the National Programmatic Agreement among the BLM, Advisory Council on Historic Preservation and the National Conference of State Historic Preservation Officers; and the State Protocol Agreement (SPA) between BLM Nevada and the Nevada SHPO.
The SHPO has reported inconsistencies to the Nevada State Office in how BLM Nevada district and field offices are reporting results of identification of properties of traditional religious and cultural importance. The attached draft instruction memorandum is designed to clarify information to be provided to SHPO under terms of the SPA. Please examine this draft and respond with comments, preferably using the enabled Track Changes device.
No new policies with tribal implications are involved, and no tribal consultation is necessary to adopt and implement these procedures intended to maintain effective communication and consultation processes between BLM Nevada and Nevada SHPO, per the SPA and relevant regulations.
