Subject: Special Recreation Permit Administration

Program Area: Recreation and Visitor Services – Special Recreation Permits (SRPs)

Purpose: The purpose of this Instruction Memorandum (IM) is to re-emphasize agency requirements and establish policy for Bureau of Land Management (BLM) Nevada Offices regarding the administration of special recreation permits (SRP) for commercial, competitive use, and organized group activities and events.

Issuing an SRP is a discretionary action. Applications for a SRP may be denied based upon factors such as non-compliance with land use plans or designations; a moratorium on permits issued as part of a planning process; the results of an environmental analysis; other resource values; an allocation system; public health and safety concerns; the applicant’s past performance; or the inability of the managing office to issue, manage, and monitor the proposed use. The authorized officer may also consider previous convictions for violating federal or state laws or regulations concerning the conservation or protection of natural resources, the environment, endangered species or antiquities or other related or germane uses to the proposed permit. (43 CFR 2932.26)The decision to not issue a permit is appealable.

Policy/Action: It will be BLM Nevada policy not to issue a SRP submitted from an individual or group that is on current suspension of SRP privileges resulting from the evaluation of past performance for a similar type of permit/event from another BLM Office. It will remain the discretion of the Authorized Officer to issue a SRP to an individual or group that is on probation for past performance from another BLM Office.

Background: The BLM is responsible for issuing and administering SRPs for commercial, competitive use, and organized group activities and events as a means of authorizing uses on public lands and related waters. Offices are directed to 43 CFR Part 2930, the BLM Manual 2930, and the H-2930-1 Recreation Permit Administration Handbook for detailed guidance on issuance of special recreation permits.

Timeframe: Effective immediately.

Budget Impact: This policy has no impact on budget.
