Subject: Fluid Minerals Leasing Supplemental Procedures (appendix to the State Protocol
Agreement)
Purpose: This Instruction Memorandum transmits the extended Fluid Minerals Leasing
Supplemental Procedures.
Policy/Action: This Instruction Memorandum transmits Fluid Minerals Leasing Supplemental Procedures (Supplement). District and Field Offices are instructed to use the Supplement in place of the 2013 Fluid Minerals Leasing Supplemental Procedures, appended to the State Protocol Agreement. The 2013 supplemental procedures expired in February 2016. The Supplement is needed to extend these state-specific Section 106 National Historic Preservation Act procedures for fluid minerals leasing. With the exception of the expiration date, there has been no revision to these procedures.
Timeframe: This IM is effective immediately.
Background: In February 2014, the Bureau of Land Management (BLM) California State Office and the California and Nevada State Historic Preservation Officers executed the State Protocol Agreement. This agreement describes how the BLM meets our responsibilities under provisions of the National Historic Preservation Act and the 2012 National Programmatic Agreement among the BLM, the Advisory Council on Historic Preservation, and the National Conference of State Historic Preservation Officers. An appendix of the State Protocol Agreement is the Supplemental Procedures for Fluid Minerals Leasing. These supplemental procedures were originally executed in 2008 and received minor revisions in 2013 when they were extended to February 2016. To replace these expired supplemental procedures, the Supplement has been executed by the California State Director and California and Nevada State Historic Preservation Officers for five years, to February 11, 2021.
Action: Update the appendix section of State Protocol Agreement copies in your office by replacing the expired supplement with the one transmitted herein.
