Subject: Information on Recent Regulatory Change Affecting Landfills Leased under the Recreation and Public Purposes Act prior to November 9, 1988
On August 26, 2008, a final rule was published in the Federal Register that revised 43 CFR §2743.3(a). The revised regulation deletes the requirement for the Director of the Bureau of Land Management (BLM) to approve patents for solid waste disposal sites or similar purposes leased prior to November 9, 1988. The rule will become effective on October 27, 2008.
The deletion of this non-statutory requirement means that BLM State Offices are able to issue such patents without Washington Office involvement. As indicated in Instruction Memorandum No. 2006-238, landfill patents remain a high priority for the BLM. A list of unexpired solid waste disposal leases compiled from the LR2000 database system is attached.
